Rights of Patients and Their Families

  1. The Right to Access Services in a Fair and Equitable Manner
  • Patients seeking services from our hospital have the right to benefit from available diagnostic, treatment, and rehabilitation options, regardless of their beliefs or social characteristics.
  • Our institution and the healthcare personnel employed here may not administer diagnoses or treatments that are contrary to medical principles and rules or that are deceptive in nature.
  • At our hospital, all patients are encouraged to participate in their care and treatment process and have access to informational brochures to support their education and involvement.
  1. Right to Information and Informed Consent
  • Provided that his health is not adversely affected, our patient has the right—either personally or through his legal representative—to receive verbal and written information from the physician responsible for coordinating his treatment regarding the probable or definitive diagnosis of his condition, the procedures to be performed, the treatment, its benefits and potential risks, alternative treatment methods, and the primary consequences that may arise if treatment is refused.
  • The physician explains the proposed treatments, potential complications, and risks to the patient and/or his legal representative and obtains their informed written consent. For the explanation to be valid, the patient must be mentally capable of understanding the information provided. If our patients are asked to participate in any scientific study to be conducted within our hospital, the written consent of the patient or a close relative is required.
  1. Right to Communication
  • Provided that an interpreter is available and the cost can be covered, a patient who does not understand the official language has the right to request an interpreter for communication purposes.
  • Provided it does not adversely affect his treatment and with the approval of the attending physician, the patient has the right to communicate with individuals outside the hospital in person, by telephone, through visits, or by mail. The duration and timing of telephone calls, as well as visiting hours, are determined by our hospital.
  1. Right to Choose and Change Staff and/or Healthcare Provider
  • Our patient has the right to choose his physician and/or healthcare facility and to change them at any stage of treatment.
  • Subject to compliance with applicable laws and the procedures established by our hospital, the patient has the right to freely select and change the staff who will provide healthcare services to him, as well as to request consultations with other physicians.
  1. Provision of Medical Care
  • The staff provides the medical care required by the patient’s condition. Even if it is not possible to save the patient’s life or protect his health, it is mandatory to strive to reduce or alleviate his suffering.
  1. Right to Privacy
  • This is the right to have information regarding the patient kept confidential. Information about the patient may not be overheard or disclosed to others without the patient’s consent.
  • Patient records stored on computers may only be accessed by those responsible for the patient’s care. It is important not only for staff to observe and protect these rights but also for patients to be informed about such rights.
  • Information regarding our patients may not be shared in public settings or areas where others are present.
  • Only authorized personnel may access our patients’ health assessments.
  • Our patients’ healthcare expenses and their sources are kept confidential from anyone other than the relevant staff. Other healthcare professionals do not comment on pricing or payment matters.
  • Our patients’ right to privacy is never compromised under any circumstances.
  • All of our patients’ examinations, procedures, and treatments are conducted in an environment that meets privacy requirements.
  • If conversations with a patient are to be listened to or observed by others for educational purposes, the patient’s prior consent must be obtained; the patient must not feel pressured when giving this consent.
  • If images from the psychiatry department are to be published in print or broadcast media, care is taken to ensure that patients’ identities remain unrecognizable.
  • The right to privacy is waived if the life of a third party or public health is at risk. By notifying the individual in question and the relevant legal authorities, the patient’s violent behavior can be prevented.

Rights of Data Subjects

  • As data subjects, you may submit requests regarding your rights by filling out the “Personal Data Information and Request Form” available on our website and delivering it in person, signed, to the address of the hospital where you received services; by sending it via a notary public; or by sending a secure email signed with your personal electronic signature toemail signed with your secure electronic signature, or by emailing a “Word or PDF” file signed with your secure electronic signature to kisiselveri@npistanbul.com; NPİSTANBUL Hospital will process the request free of charge as soon as possible and no later than thirty days, depending on the nature of the request. However, if the process incurs additional costs beyond the legal requirements for free processing, NPİSTANBUL Hospital may charge a fee in accordance with the tariff determined by the Personal Data Protection Board. In this context, data subjects have the right to:
  • The right to learn whether personal data has been processed,
  • Request information regarding the processing of his personal data, if it has been processed,
  • To learn the purpose of the processing of his personal data and whether it is being used in accordance with that purpose,
  • To know the third parties to whom his personal data has been transferred, whether within or outside the country,
  • Request the correction of personal data if it has been processed incompletely or incorrectly, and request that the third parties to whom the personal data has been transferred be notified of such correction,
  • To request the erasure or destruction of personal data if the grounds requiring its processing no longer exist, even if it has been processed in accordance with Law No. 6698 and other relevant laws, and to request that the third parties to whom the personal data has been transferred be notified of this action,
  • The right to object to a decision made solely through the automated processing of personal data that adversely affects him,
  • The right to request compensation for damages suffered as a result of the unlawful processing of personal data.
  1. Right to Refuse or Discontinue Treatment
  • Except where required by medical or legal necessity, our patients have the right to approve or refuse treatment decisions after receiving comprehensive information about the proposed treatment.
  • Except in cases where it is medically or legally required, a patient may withdraw his consent. If a patient refuses treatment, the consequences of not receiving treatment are explained to the patient or his legal representative, and a Treatment Refusal Form is signed.
  • A patient who has previously refused treatment retains the right to receive necessary medical care and treatment upon re-application. This situation will not be used against the patient upon his re-application.
  1. Right to Consultation
  • The patient or his first-degree relatives have the right to request a consultation with another specialist, subject to his consent. However, if the treatment recommended as a result of the consultation is agreed upon by the patient’s attending physician, it is carried out by the staff of the healthcare facility where the patient is being treated.
  1. Right to Know the Costs of Tests and Treatments
  • The patient or his legal representative has the right to request and receive a clear and detailed invoice of the fees to be paid for the services provided by the healthcare facility.
  1. Right to Safety
  • Our hospital takes the necessary measures to protect and ensure the personal safety and property security of patients and visitors.
  • A controlled access system is in place for floors housing patients in high-risk groups.
  • All of our hospital staff wear ID badges.
  • Our hospital is continuously monitored by security cameras to protect against theft, loss, and physical assault, and allows for immediate intervention in the event of a problem.
  • Our hospital has a security plan in place for potential disasters and emergencies.
  1. Right to Have a Companion
  • During examinations and/or treatment, a companion may be permitted to assist the patient to the extent that institutional resources allow and the patient’s health condition requires, subject to the approval of the attending physician.
  • A nurse or healthcare security staff member is always present during any procedure performed on our patients, as appropriate for the patient’s condition.
  1. Right to Keep Personal Belongings During Hospitalization
  • Patients may bring their personal belongings to the hospital. However, items that could pose a safety risk to the patient are collected by a nurse and stored in a secure location, to be returned to the patient later, on the condition that the patient uses them when necessary and returns them afterward.
  1. The Right to Perform Religious Obligations and Access Religious Services
  • Our patients have the right to fulfill their religious obligations to the extent permitted by our hospital’s resources and within the framework of the measures taken.
  1. Right to File a Complaint
  • Our patients have the right to file a complaint, to have their complaints considered and evaluated, and to be informed of the outcome.
  • Furthermore, while reserving the right to file a complaint with relevant professional organizations and courts, patients have the right to first report complaints regarding patient rights to the hospital’s medical or administrative authorities.
  • If a resolution cannot be reached by the relevant authorities, or if the patient who filed the complaint does not accept the resolution, the patient has the right to appeal to the highest local administrative authority in the jurisdiction where the healthcare facility is located.
  1. Right to Seek a Second Opinion
  • The patient has the right to obtain information about his health condition from a physician in the same specialty—other than the physician treating him—who is designated by the institution or by the patient or his legal representative.

Responsibilities of Patients and Their Relatives

  1. Patients’ Responsibilities Regarding Visitor Policy
  • Patients must receive visitors in accordance with the rules established by the healthcare facility. Visiting hours and days at our hospital are communicated to patients and their relatives upon admission. Visitors are not permitted outside of these hours and days.
  • Children between the ages of 0 and 10 should not be admitted as visitors (to protect the health of the children).
  • Patients should not ask visitors to bring food or beverages of any kind, nor should they accept such items from visitors.
  • Visitors should not bring anything for other patients; if such items are brought, they should not be accepted by the patient.
  • As few visitors as possible should be admitted at any one time.
  • Visitors should help ensure that items belonging to their own patient or other patients are not used and that visitors are prevented from sitting on patient beds.
  1. Responsibility to Provide Information
  • The patient must disclose all past medical history and report any changes that occur during and after treatment at the hospital.
  • While the patient is in our hospital, the dosages and administration instructions for the medications prescribed by his doctor will be documented in his medical record. Although the likelihood is very low, side effects may occur while taking these medications. In such cases, the patient must inform his doctor.
  • The patient must confirm whether he has correctly understood what is expected of him regarding the procedures and treatments to be performed.
  • If the patient is to follow a special diet during his hospital stay, he must inform our hospital of this.
  1. Compliance with Recommendations
  • The patient is obligated to adhere to the treatment plan recommended by the physician responsible for his care and to accept that nurses and other relevant healthcare personnel will carry out the care plan in accordance with the physician’s instructions.
  1. Responsibility for Refusing Planned Treatment
  • The patient is personally responsible for any consequences arising from his refusal of the planned treatment or failure to comply with the doctor’s instructions.
  1. Examination and Treatment Costs
  • The patient or his relatives must indicate how the medical expenses will be paid.
  • If the patient’s expenses are covered by any institution, the patient must provide the relevant documentation. (In emergency situations, these documents are not required.)
  • If the patient is to make the payment personally, he must do so within the timeframe specified by the institution.
  1. Responsibility to Comply with Hospital Rules and Procedures
  • Our patients, their companions, and visitors are required to comply with the rules and procedures established by our institution. These rules are communicated to our patients upon admission.
  1. Showing Respect
  • Patients must respect the rights of other patients and hospital staff. In cases of non-compliance, patients must comply with the measures taken by the administration.
  1. Infectious Diseases
  • Patients with a suspected or diagnosed infectious disease should not request discharge without permission unless their attending physician confirms that it is safe for them to do so.
  1. Unreasonable Requests
  • The patient must not request the administration of any medication or procedure that is not deemed appropriate by the attending physician or is not included in the treatment plan.
  1. Liability for Compensation
  • The patient must compensate for any damage or loss caused by negligent use or intentional acts to the healthcare facility’s fixed assets or consumables.
